These Terms & Conditions (“Terms”) govern your access to and use of this website, your purchases, and your relationship with FTW DMA. By using this website or placing an order, you agree to be bound by these Terms.
1. About Us
This website (ftwdma.com) is operated by Aleczanda & Co PTY LTD (ABN 92 662 872 611) trading as FTW DMA (“FTW DMA”, “we”, “us”, “our”).
These Terms apply to all users, customers, and visitors of this website.
2. Definitions
- ACL: Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
- Consumer Guarantees: The non-excluded rights and guarantees under the ACL.
- You / Your: Any person accessing the website or making a purchase.
3. Acceptance of Terms
By accessing this website, creating an account, communicating with us, or placing an order, you agree to these Terms and all referenced policies (including our Privacy Policy and Returns & Refunds Policy).
If you do not agree, you must not use this website.
4. Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts, or modifies any rights available under the ACL. Where Consumer Guarantees apply, remedies (such as repair, replacement, or refund) will be provided as required by law.
5. Eligibility & Lawful Use
You must be at least 18 years old and have legal capacity to enter into a contract.
You must not:
- use the website for unlawful purposes
- engage in fraud, abuse, harassment, or misrepresentation
- attempt unauthorised access or system interference
- scrape, copy, reverse-engineer, or exploit our systems or content
We may suspend or terminate access for violations.
6. Accounts & Security
If you create an account:
- you are responsible for maintaining confidentiality of your login credentials
- all activity under your account is your responsibility
- we may suspend or terminate accounts for misuse or breach
7. Orders, Pricing & Payments
- All prices are in USD unless stated otherwise.
- Payment must be received and cleared before dispatch.
- We may refuse, cancel, or limit orders for fraud prevention, compliance, stock issues, or pricing errors.
8. Shipping & Delivery
- Shipping costs, methods, and estimated timeframes are shown at checkout.
- Delivery times are estimates only. We are not responsible for carrier delays, customs delays, or force majeure events.
9. Risk, Title & Customs
- Risk passes to you when the goods are handed to the carrier (unless otherwise required by law).
- Title (ownership) passes only after payment is final, settled, and non-reversible.
- For international orders, you are responsible for any import duties, VAT/GST, brokerage, and customs clearance fees unless expressly stated at checkout.
- If delivery fails due to refused customs charges or failure to clear customs, you may be liable for return shipping, storage, redirection, and administrative costs.
10. Product Information & Compatibility
FTW DMA supplies specialised technical hardware and firmware. Compatibility is not guaranteed and may vary based on hardware, software, firmware, operating systems, third-party updates, and configuration. Any guidance we provide is general information only and not professional advice.
11. Third-Party Software, Platforms & Services
We do not control or guarantee third-party systems (including game updates, anti-cheat systems, operating system updates, or external software/services). Changes made by third parties are not considered product defects.
12. Acceptable Use
You must not:
- misuse products or services
- facilitate illegal activity
- post harmful, defamatory, infringing, or unlawful content
- disrupt website operations
13. Intellectual Property
All content, branding, logos, images, text, and software on this website are owned or licensed by FTW DMA. You must not reproduce, distribute, modify, or create derivative works without our written permission.
14. Change-of-Mind Returns & Cancellations
A. General Rule
Change-of-mind returns and cancellations are not guaranteed.
B. If Approved in Writing
- Goods must be unused, uninstalled, unmodified, and complete.
- Original packaging and all accessories/components must be included.
- Return shipping is the customer’s responsibility (unless required by law).
- Original shipping costs are non-refundable.
- A restocking fee of up to 20% may apply.
- Refunds are processed only after goods are received and inspected.
C. Cancellations (Before Shipping)
If you request a cancellation for change-of-mind before shipping, we may charge a reasonable administrative/processing fee of up to 10% to cover non-recoverable costs such as payment processing fees, administrative labour, and order preparation, where permitted by law and disclosed here.
D. Returns (After Delivery)
If a change-of-mind return is approved after delivery, a restocking fee of up to 20% may apply to cover inspection, repackaging, and inventory handling, where permitted by law.
E. Custom / Special Orders
Custom, specially prepared, or special-order items may be non-refundable, or may be subject to documented preparation costs and genuine losses incurred as a result of the cancellation (where enforceable and permitted by law).
F. ACL Compliance
This section does not limit your rights under the ACL.
15. Faulty Products & Consumer Remedies
If a product is faulty, unsafe, or not as described, contact us with reasonable supporting evidence (photos/video/details) so we can assess and provide a lawful remedy. Where Consumer Guarantees apply, remedies will be provided as required by law.
16. Payment Disputes & Chargebacks
- Please contact us first before initiating a chargeback so we can attempt to resolve the issue.
- If a payment is reversed, disputed, or charged back, the goods may be treated as unpaid for and we may pursue recovery of goods/value and associated costs, where permitted by law.
- We may submit evidence to banks/card networks and may suspend accounts for suspected fraud or bad-faith disputes.
17. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses. Where liability cannot be excluded, our liability is limited to the remedies available under the ACL (including repair, replacement, or refund as required).
18. Privacy & Data Protection
We handle personal information in accordance with our Privacy Policy and applicable laws (including the Australian Privacy Act, and where applicable the UK GDPR and EU GDPR).
19. EU & UK Consumer Rights
If you are located in the UK or EU/EEA, you may have additional mandatory rights under local consumer laws (including the UK Consumer Rights Act 2015 and the UK Consumer Contracts Regulations 2013, and EU consumer protection laws). Nothing in these Terms limits those mandatory rights.
20. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier disruptions, customs/regulatory actions, sanctions, or system outages.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain valid.
22. Changes to Terms
We may update these Terms at any time to reflect changes in law, regulatory requirements, business practices, or operational needs. Continued use of the website constitutes acceptance of the updated Terms.
23. Governing Law
These Terms are governed by the laws of Australia. To the extent permitted by law, disputes are subject to the jurisdiction of the courts of Western Australia.
